This disclaimer is an integral part of our professional service agreement. By engaging in services provided by KinEquis, you, the client, acknowledge and agree to the following terms and conditions regarding the health, safety, and well-being of all parties involved.
1. General Disclaimer
KinEquis's services are for the sole purpose of therapeutic and relaxation-based massage and bodywork. We are not a substitute for veterinary or medical care. We do not diagnose, treat, or cure any medical conditions, diseases, or injuries in either humans or horses.
We strongly recommend that you consult with a licensed veterinarian for your horse's medical conditions and a medical doctor for your own health concerns before beginning any massage or bodywork regimen.
All information provided during a session is for educational purposes only and is not intended to be diagnostic or prescriptive in nature.
2. Equine Services: Health and Safety
Veterinary Consent: You, the horse owner/caretaker, are responsible for ensuring that your horse has been cleared by a licensed veterinarian for massage and bodywork. You must inform the therapist of any pre-existing medical conditions, injuries, or recent veterinary treatments. The therapist reserves the right to refuse service if there is any concern about the horse's health or safety, and will not work on a horse with a fever, open wounds, acute trauma, or signs of lameness or neurological distress without prior veterinary consent.
Assumption of Risk: You acknowledge that working with horses, even those that are typically calm, carries inherent risks. Horses are large, powerful animals, and unpredictable behavior can occur. You voluntarily assume all risks associated with the equine massage session, including the risk of injury to yourself, the horse, or your property.
Safe Environment: You are responsible for providing a safe and suitable environment for the session. This includes, but is not limited to, a calm and secure area for the horse, clear of obstacles or hazards. The horse must be securely tied or safely contained in a stall. The therapist is not responsible for any injury or damage resulting from the horse's behavior or an unsafe environment.
3. Human Services: Health and Safety
Medical Disclosure: It is your responsibility to provide a complete and accurate health history. This includes informing the therapist of any medical conditions, injuries, allergies, or medications you are currently taking. Certain conditions may be contraindications for massage. Failure to disclose relevant information may result in an altered session or a cancellation of the service without refund.
Safe Environment: The client is responsible for providing a clean, private, and safe space for the massage session. This includes ensuring the area is free from pets, children, or other distractions that may compromise the safety or quality of the session. The therapist reserves the right to terminate a session at any time if they feel their personal safety is at risk.
4. Liability and Indemnification
You agree to release, indemnify, and hold harmless KinEquis and its therapists from any and all liability, claims, or causes of action for any injury, loss, or damage to you, your horse, or your property that may arise from the provision of our on-site services.
This waiver of liability applies to any and all circumstances, including those that may arise from the negligence of the therapist.
